CONTEST RULES AND REGULATIONS
THE FM96 “CAT IN THE HAT2” CONTEST
1. THE CONTEST AND THE CONTEST PERIOD
The FM96 CAT IN THE HAT2 contest (the “Contest”) commences on February 14, 2010 at 9:00 a.m. Eastern Standard Time (“EST”) and concludes on April 30, 2010 at 5:00 p.m. EST (the “Contest Period”).

3. ELIGIBITY
The Contest is open to residents of Ontario, who have attained the age of nineteen (19) and live in the City of London, but excluding employees and directors of CFPL-FM (“FM96”), Corus Entertainment Inc. (“Corus”), any affiliate (as defined in the Canada Business Corporations Act) of FM96 or Corus (the “Affiliates”), employees, directors and officers of James O. Poag Jewellers Ltd., Phaeton Automotive Group, Strathroy Audio & Video/ TREWinc., Universal Music, Stream Whistle Brewing, and Lastman’s Bad Boy (the “Sponsors”), employees, directors and officers of their respective advertising and promotional agencies, as well as family members of any of the foregoing. Entrants must be members of the FM96 Freeloader Club (the “Club”). To become a member, visit www.fm96.com (the “Website”) and complete and online registration form. Existing members of Club are eligible to enter.
4. HOW TO ENTER
Listeners may enter in one of two ways:
(a) Phase I – February 14, 2010 at 9:00 a.m. – March 4, 2010 at 5:00 p.m. (the “Entry Period”)
Club members may enter during the Entry Period by visiting the Website and completing a Contest registration form in full. Completed entry forms may be submitted online, or printed and faxed to 519-679-1967. On March 5, 2010, 60 entrants will be randomly selected to advance to Phase II (the “Qualifiers”), and contacted by telephone before 5:00 p.m. Qualifiers will be invited to attend one of two Contest workshops on March 8, 2010 at either 7:30 a.m. or 5:30 p.m. at FM96 studios located at 380 Wellington Street Room 222 London, Ontario N6A 5B5 (the “Workshops”). Contest instructions will be distributed at the Workshops. Failure to attend either Workshop will result in disqualification.
(b) Phase II – March 8, 2010 at 8:00 a.m. – April 30, 2010 at 5:00 p.m. (the “Hat-wearing Period”)
(i) Qualifiers will be given a hat at the Workshop, each containing a unique numerical code. Qualifiers will be required to wear the Contest hat assigned to them at all times during the Hat-wearing Period (other than while in their home bathrooms). During the Hat-wearing Period, FM96 staff will be searching the City of London for Qualifiers. If, when found, the Qualifier is wearing the Hat assigned to them, he or she will be given the chance to choose between two (2) envelopes, each containing a prize of nominal value (the “Secondary Prize”). Qualifiers who are found wearing the Hat, and who are not otherwise eliminated according to part (ii), below, will advance to Phase III (the “Finalists”). Qualifiers found not wearing the hat, or wearing a hat not assigned to them will be immediately disqualified.
(ii) Every Thursday during the Hat-wearing Period, five (5) Qualifiers will be randomly selected from the pool of sixty and required to attend FM96 studios to play “Knock the Cat-Outta-the-Hat”. One (1) Qualifier will be eliminated each week. Failure to participate in “Knock the Cat-Outta-the-Hat” will result in disqualification. Finalists not eliminated will become Finalists.
(iii) Entrants who have not been selected to become Qualifiers may qualify to win a Contest prize pack (the “Prize Pack”) by emailing FM96 at cat@fm96.com during the Hat-wearing Period his other contact information along with a digital photo or video of a Qualifier wearing the hat (the “Photo Entrants”). At various times during the Hat-wearing Period, one (1) Photo Entrant will be randomly selected, and announced on-air as the winner of a Prize Pack. Photo Entrants who win a Prize Pack will be contacted by telephone to inform them of having won a Prize Pack.
(c) Phase III – April 30, 2010 at 4:30 p.m.
Finalists will be invited to attend the Grand Prize party on April 30, 2010 at a location to be announced (“Event”). At the time of invitation the location of the Grand Prize party will be disclosed. Every Finalist attending the Event must register at the to be announced location wearing their hat by 4:30 p.m., failing which he or she will be disqualified. One (1) Finalist at the Event will be randomly selected in a reverse draw and awarded $10,000 cash (the “Grand Prize”). If a Finalist is not present at the Final Event, he or she will forfeit the chance to win the Grand Prize.
PRIZE VALUES
The value of the Grand Prize is CDN $10,000. Secondary Prizes have a value of between $25 and [$50.00]. Prize Packs have a value of between [$25.00] and [$50.00] (unless otherwise specified, the “Grand Prize, Secondary Prizes and Prize Packs” hereinafter referred to as a “Prize” or “Prizes”).
5. CONTENT RIGHTS
By entering the Contest, each entrant grants to FM96, Corus and the Sponsors (i) the non-exclusive right and license to publish, display, reproduce, modify, edit or otherwise use the photographs and video provided by each entrant, in whole or in part on the Website and/or for advertising or promoting the Contest or for any other reason; (ii) permission to use his or her first name, address, voice, statements about the Contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by FM96 or the Sponsors in any manner whatsoever, including print, broadcast or the Internet; and (iii) to release and hold harmless FM96, the Sponsors and its advertising and promotion agencies, and each of their respective agents, employees, directors, successors, and assigns, against any and all claims, injury or damage arising out of or in relating to participation in the Contest, and further against any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related cause of action.
6. DEADLINE FOR CLAIMING PRIZES
The Grand Prize winner must be in attendance at the Final Event to claim the Grand Prize. The deadline to claim a Secondary Prize or a Prize Pack is May 30, 2010 (the “Deadline”) by attending the FM96 studio at 380 Wellington St London Ontario Room 222, London, Ontario. If a Prize winner fails to claim their Prize (either the Secondary Prize or Prize Pack) by the Deadline or to inform FM96 of his or her inability to claim the prize before the Deadline, his or her entry will be forfeited.
7. LIMITATION ON NUMBER OF ENTRIES PERMITTED
Only one entry per person per household is permitted. Multiple entries will be discarded. Entries are subject to verification and will be declared invalid if they are reproduced, falsified, altered or tampered with in any way.
8. CHANCES OF WINNING
Chances of winning depend on the total number or registered Contest participants.
9. NO REPRESENTATIONS OR WARRANTIES
Neither FM96 nor Corus makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prizes. The Prize winners understand and acknowledge that they may not seek reimbursement or pursue any legal or equitable remedy from FM96 or Corus should the Prize fail to be fit for its purpose or is in any way unsatisfactory to the Prize winners.
10. DECLARATION AND RELEASE OF PRIZE WINNER
Before being awarded the Prize the Prize winners must:
a) Correctly answer, unaided, a time-limited skill-testing mathematical question; and
b) Sign a standard form confirming that by entering the Contest:
- he or she read, understood and accepted these rules and regulations;
- that he or she understands that acceptance of the Prize may involve danger and/or exposure to risks and hazards of both man-made and natural origin, whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury, illness or even death;
- that he or she nevertheless freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and winning the Prize; and
- that he or she releases FM96, Corus, the Affiliates, the Sponsors, and all of their directors, officers, employees, agents as well as their respective advertising and promotional agencies (collectively, the “Releasees”) from any and all liability arising in connection with participation in the Contest and acceptance of the Prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury including death or damage to or loss of property suffered or incurred or arising from participating in the Contest or accepting the Prize, whether suffered by the Prize winners or their guest, or by their heirs, administrators, personal representatives or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.
11. PRIZE TO BE ACCEPTED AS AWARDED
The decision of the Contest judges is final, and the Prize must be accepted as awarded. No portion of the Prize is transferable. Neither the Prize is redeemable for cash and no substitute for any portion of the Prize is offered. Should the Prize winners be unable to claim the Prize as awarded, his or her entry will be forfeited and another eligible Contest entrant will be selected.
12. SUBSTITUTION OR CHANGE TO THE CONTEST
FM96, Corus, the Sponsors and their respective advertising and promotional agencies reserve the right to substitute the Prize, or any component thereof, for those of approximately the same value and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.
13. OWNERSHIP OF ENTRIES
All entries shall become the property of FM96, Corus, the Sponsors and their advertising and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed or otherwise indecipherable entries due to any failure or technical malfunction of the telephone network, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, failure of any email or submission or due to any other reason regardless of cause.
14. CONSENT TO USE OF PERSONALITY
By entering the Contest, each entrant, including the Prize winners, consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality for any publicity and programming purposes, commercial or otherwise, in all media used by FM96, Corus, including on the website of FM96, without any payment or compensation. The Prize winners further agree that his or her audio reaction may be used for on-air promotional purposes. The entrants understand and acknowledge that FM96 may contact him or her on-air without prior knowledge as a result of his or her participation in the Contest.
15. CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION
By entering the Contest and voluntarily providing personal information including, but not limited to, name, address, city, email address, home and office telephone numbers (the “Registrant Information”), each Contest entrant grants permission to FM96, Corus and the Sponsors to the collection and use of the Registrant Information for the exclusive purpose of administering the Contest and selecting the Prize winners. No correspondence will take place between FM96, Corus, the Sponsors and the entrants except in connection with the Contest and, in the case of the Prize winners, as a result of entering the Contest and winning the Prize.
16. NO DISRUPTION TO CONTEST
All Contest entrants agree to respect the entry process and the operation of the Contest as outlined in these rules and regulations. FM96, Corus or the Sponsors may disqualify or ban from future contests any Contest entrant or person who FM96, Corus or the Sponsors believe is tampering with the entry process or the operation of the Contest, to be acting in a disruptive or unsportsmanlike manner, or behaving with the intent to annoy, abuse, threaten or harass any person associated with FM96, Corus or the Sponsors. Any attempt to deliberately damage a website or to undermine the legitimate operation of a contest is a violation of criminal and civil laws, and should any such attempt be made by a Contest entrant or other person, FM96, Corus and the Sponsors may seek damages or other relief from such Contest entrant or other person to the fullest extent permitted by law.

18. COMPLIANCE WITH CONTEST RULES
All contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of FM96, Corus and the Sponsors.
19. COMPLIANCE WITH LAWS
This Contest is void where prohibited by law, and is subject to all federal, provincial, territorial and municipal laws and regulations of Canada and of each province, territory and municipality of Canada, respectively.
